1.1. This Warranty and Complaint Policy (hereinafter referred to as the "Policy") governs the legal relationships between the company:

The Seller is a VAT payer.
(hereinafter referred to as the "Seller" or "Merchant") and any person who is a Buyer of products offered by the Seller on the Seller’s Website and who acts as a consumer in accordance with further provisions of these General Terms and Conditions and relevant laws defining consumers under the applicable legislation of the Slovak Republic, particularly the following laws: Act No. 108/2024 Coll. on Consumer Protection and Amendments to Certain Laws, as amended, Act No. 40/1964 Coll. Civil Code, as amended, except as stated in section 4.4 of this Warranty and Complaint Policy, which regulates the legal relationship between the Merchant and the Buyer who does not act as a consumer.

Basic Provisions
2.1. This Warranty and Complaint Policy regulates the legal relationships between Buyers who are consumers and the Seller.
Exercising Warranty Rights for Defects
3.1. The Buyer may claim warranty rights for defects only if they notify the Seller of the defect without undue delay, but no later than 24 months after taking possession of the goods. If the Buyer fails to notify the Seller of the defect within this period, the warranty rights for defects expire.
Liability for Defects
4.1. The Seller is responsible for any defect that the goods had at the time of delivery and which manifests itself within two years from the delivery of the goods.
4.2. If the purchased item contains digital elements and digital content or digital services are to be provided continuously for the agreed period, the Seller is responsible for any defects in the digital content or digital service that occur or appear during the entire agreed period, but at least for two years from the delivery of the item with digital elements.
4.3. For used goods, the parties may agree on a shorter liability period than stated in sections 4.1 and 4.2, but not shorter than one year from the delivery of the goods.
4.4. The Seller is responsible for any defect the goods had at the time of delivery to the Buyer and which manifests itself within six months from the delivery of the goods if the Buyer does not act as a consumer.
Warranty Rights
5.1. If the Seller is responsible for a defect in the sold goods, the Buyer has the right to have the defect repaired or the goods replaced, the right to a reasonable discount on the purchase price, or the right to withdraw from the purchase contract.
5.2. The Buyer may refuse to pay the purchase price or part of it until the Seller fulfills its obligations arising from liability for defects, unless the Buyer is in default with payment at the time of the defect claim.
5.3. The Buyer must notify the Seller of the defect within two months of discovering it, but no later than within the periods stated in sections 4.1 to 4.3 of this Warranty and Complaint Policy.
5.4. Exercising warranty rights does not exclude the Buyer's right to compensation for damages caused by the defect.
Claiming Defects
6.1. A defect can be reported at any business premises of the Seller, at another designated person notified by the Seller to the Buyer before concluding the contract or before sending the order, or through remote communication means to the Seller's registered office or business address.
6.2. If the Buyer notifies the Seller of the defect via postal shipment and the Seller refuses to accept the package, the shipment is considered delivered on the day of refusal.
6.3. The Seller shall provide the Buyer with a written confirmation of the defect notification immediately after the Buyer has notified the defect.
6.4. If the Seller refuses liability for defects, it must inform the Buyer in writing of the reasons for the refusal.
Defect Removal
7.1. The Buyer has the right to choose whether the defect should be removed by repair or replacement of the goods.
7.2. The Seller may refuse to remove the defect if repair or replacement is not possible or if it would cause excessive costs.
7.3. The Seller shall repair or replace the goods within a reasonable time, free of charge, at its own expense, and without causing significant inconvenience to the Buyer.
7.4. The Buyer shall hand over or make the goods available to the Seller for repair or replacement.
7.5. The Seller shall deliver the repaired or replaced goods to the Buyer at its own expense using the same or similar delivery method unless agreed otherwise.
7.6. If the Buyer does not collect the repaired or replaced goods within six months of the collection deadline, the Seller may sell the goods.
Liability for Defects in Digital Content
8.1. The Seller is responsible for any defect in the digital content at the time of delivery and which appears within two years of delivery.
8.2. The Seller shall remove the defect within a reasonable period at no cost to the consumer.
Liability for Service Defects
9.1. The Seller is responsible for defects in a service-provided product that were present when the Buyer took possession of it.
9.2. If a defect appears within 24 months from the time the Buyer was supposed to take possession of the product, it is presumed that the defect existed at the time of acceptance.
Final Provisions
10.1. This Warranty and Complaint Policy is an integral part of the General Terms and Conditions and Privacy Policy of this Website. These documents are published on the domain bikepeakstore.com.
10.2. This Warranty and Complaint Policy is valid and effective from the date of its publication on the Seller’s Website, July 1, 2024.
